1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of Dreamy (“Dreamy”, “we”, “us”, or “the Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Dreamy is intended to be used by parents or legal guardians on behalf of their children. By using the Service, you confirm that you are at least 18 years old and that you are acting as a parent or legal guardian, or with the permission of a legal guardian, for any child whose image or data is used.
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
2. Description of the Service
Dreamy is a web-based application designed to help parents create magical, AI-generated images for their children.
The Service allows users to:
- Upload or capture photos (e.g. selfies)
- Provide text or voice descriptions of imaginative scenes
- Generate AI-decorated images based on those inputs
- Order physical products featuring generated images
Dreamy uses third-party artificial intelligence technologies to generate images and process voice input. AI-generated results are creative interpretations and may vary in appearance, style, and accuracy. Dreamy does not guarantee photorealistic results or specific outcomes.
The Service is provided for creative and entertainment purposes only.
3. Accounts and Parental Responsibility
Some features of Dreamy may be available without an account. To access all features, an account may be required through our authentication provider.
The account holder is always considered the parent or legal guardian.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity conducted under your account
- Ensuring that you have the legal right and consent to upload images of any child depicted
- Supervising your child’s use of the Service
You confirm that you are the parent or legal guardian of all children whose images you upload, or that you have obtained explicit consent from their parent or legal guardian.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
When using Dreamy, you agree not to:
- Upload or generate content that is illegal, harmful, abusive, threatening, defamatory, or otherwise objectionable
- Upload images of children without proper parental or legal guardian consent
- Upload images of individuals you do not have the right to represent
- Attempt to generate sexualized, exploitative, or inappropriate content involving minors
- Upload content that infringes third-party intellectual property rights (e.g. copyrighted characters or trademarks)
- Use the Service for any unlawful purpose
- Attempt to bypass, disable, or interfere with security or access controls
- Use automated systems or scraping tools to access the Service
- Disrupt or interfere with the operation of the Service or its infrastructure
We reserve the right to remove content, suspend access, or terminate accounts that violate these rules.
5. Intellectual Property and Content Rights
Your Content
- You retain ownership of the original photos you upload
- You retain rights to AI-generated images created through the Service, subject to these Terms and any limitations imposed by third-party AI providers
License to You (Personal Use)
Dreamy grants you a non-exclusive, personal-use license to use AI-generated images for:
- Personal printing
- Gifts for friends and family
- Personal social media sharing
- Use within Dreamy’s physical products
You may not:
- Sell, license, or commercially exploit generated images
- Use generated images for business purposes, advertising, or resale
- Create merchandise or products for sale using generated images
Dreamy’s Rights
- Dreamy does not use your uploaded photos or generated images for marketing or promotional purposes
- Dreamy may process and store content solely to provide the Service
- Dreamy may use anonymized, non-identifiable data (not original photos) to improve the Service, including quality, performance, and reliability
Dreamy Intellectual Property
The Dreamy name, branding, design, software, and underlying technology are owned by Dreamy and may not be copied, modified, or distributed without permission.
6. Voice Input and Third-Party Services
Voice inputs may be processed by third-party service providers to enable voice-based features.
- Dreamy does not store voice recordings
- Voice input is processed transiently and subject to the third-party provider’s terms
- Dreamy is not responsible for third-party services outside its control
7. Orders, Payments, and Refunds
Product Availability
Dreamy currently offers physical products only within Cyprus.
Payments
- Prices are displayed in Euros (€)
- Payments are processed securely through third-party payment processors
- Orders are confirmed only after successful payment
Customized Products and Refunds
Physical products are custom-made based on your selected images.
- Customized products are not eligible for cancellation or refund, except in cases of manufacturing defects or damage upon delivery
- If a product arrives damaged or defective, you must contact us within 14 days of delivery
Production and delivery timelines are estimates and may vary due to third-party providers or external factors.
8. Data Retention and Deletion
- Uploaded photos and generated images are stored for up to 12 months
- Users may request deletion of their content or account by contacting support
- Deletion requests are handled manually and may take a reasonable amount of time to process
- Some data may be retained as required by law or for legitimate business purposes
9. Termination
We reserve the right to suspend or terminate your access to the Service at any time if you violate these Terms or misuse the Service.
Upon termination, access to stored content may be removed or deleted, subject to applicable legal requirements.
10. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- AI-generated images will meet your expectations
- Results will be accurate or suitable for any particular purpose
11. Limitation of Liability
To the maximum extent permitted by law:
- Dreamy shall not be liable for indirect, incidental, consequential, or punitive damages
- Dreamy is not responsible for third-party services, AI providers, printers, or delivery partners
- Dreamy’s total liability shall not exceed the amount paid by you to Dreamy in the 12 months preceding the claim
Nothing in these Terms limits consumer rights that cannot be waived under applicable law.
12. Changes to the Service or Terms
We may modify the Service or these Terms at any time. Where required by law, we will provide advance notice of material changes.
Continued use of the Service constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to conflict of law principles.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Cyprus.
